These Terms and Conditions (T&C) apply to the use of the platform www.esskompass.com (hereinafter referred to as “Esskompass”) and all associated services, particularly the ordering of food from participating restaurants and the use of the app.
By using the website and/or the app, you agree to these T&C.
2. Contract Partner
The contract is concluded between the user and the operator of Esskompass, Esskompass GmbH, [insert address], represented by the managing directors [insert name(s)].
3. Services Provided by Esskompass
Esskompass is an online platform that allows users to order food from participating restaurants and choose from various payment methods (e.g., credit card, PayPal, bank transfer, payment upon delivery). Esskompass provides the technical infrastructure to place orders and forward them to the respective restaurants.
Esskompass itself does not offer food products but acts as an intermediary between users and restaurants.
4. Registration and User Account
To place orders via Esskompass, you must create a user account. You are required to provide accurate and complete information. Your login credentials should be kept confidential, and you are responsible for all activities carried out under your account.
Esskompass reserves the right to suspend or delete user accounts that violate these T&C or pose a security risk to the platform.
5. Conclusion of Contract and Order
A contract for the delivery of goods is concluded between the user and the respective restaurant as soon as the user completes the order, and the restaurant confirms it. Esskompass only provides the technical service for processing the order and is not directly involved in the sale or delivery.
The displayed prices on the platform are non-binding and may vary depending on the restaurant. The price for an order is displayed in the shopping cart and must be confirmed by the user before completing the order.
6. Payment
Esskompass offers various payment methods, including PayPal, credit card, bank transfer, and payment upon pickup/delivery. The user agrees to pay the full amount for the order.
Payments are processed through third-party payment service providers. Esskompass is not liable for any payments that are not correctly processed by these providers.
7. Delivery and Pickup
Delivery is carried out by the respective restaurant or by a third-party delivery service hired by the restaurant. Esskompass is not responsible for the timeliness or quality of the delivery.
The option for pickup at the restaurant is also offered by the respective restaurant. Esskompass assumes no responsibility for delays or issues with pickup.
8. Cancellation and Refund
Cancellation or return of orders is only possible if explicitly offered by the respective restaurant. Esskompass acts as an intermediary in this case and helps in contacting the restaurant.
9. Liability
Esskompass is not liable for the quality, safety, or availability of the products and services offered by the restaurants. Esskompass is solely responsible for providing the platform and the technical processing of orders.
For damages arising from defective orders, deliveries, or the quality of the ordered products, the restaurant is solely responsible.
10. Data Protection
Esskompass collects and processes personal data of users in accordance with the Privacy Policy. For more information on data processing, please refer to our Privacy Policy.
11. Changes to the T&C
Esskompass reserves the right to change these T&C at any time. The changes will be published on the website and take effect upon publication. By continuing to use Esskompass, you agree to the modified T&C.
12. Final Provisions
The laws of the Federal Republic of Germany apply. The exclusive jurisdiction for all disputes arising from or in connection with the use of Esskompass is the location of Esskompass.
If any provision of these T&C is found to be invalid, the validity of the remaining provisions shall remain unaffected.
